Rex Gorell Škoda Privacy Policy
1. PURPOSE
1.1 Rex Gorell Group is committed to providing Customers with the highest levels of service which includes protecting each Customer’s privacy. Rex Gorell Group respects the privacy and confidentiality of the Information provided by Customers and adheres to Australian Privacy Law. Rex Gorell Group only collects Information in order to properly and efficiently carry out its business and to facilitate the provision of marketing and promotion services that may be of interest to Customers.
1.2 Information about visitors to the Website is collected or stored only when knowingly and voluntarily submitted. It will not be used, misused, sold, rented or divulged to any third party except in accordance with this Privacy Policy.
1.3 This document sets out how Rex Gorell Group may collect, hold and use Information. By providing Information to Rex Gorell Group, Customers consent to its use, storage and disclosure in accordance with this Privacy Policy. Customers should read the terms of this Privacy Policy carefully.
2. DEFINITIONS AND INTERPRETATION
2.1 Defined terms
In these Terms and Conditions:
(a) Australian Privacy Law means any applicable privacy legislation to which Rex Gorell Group is subject, including without limitation the Privacy Act 1988 (Cth) and the Privacy and Data Protection Act 2014 (Vic);
(b) Rex Gorell Group means Rex Gorell Pty Ltd ACN 006 256 668, Rex Gorell Family Group Pty Ltd ACN 005 549 913, Rex Gorell Ford Pty Ltd ACN 006 175 515, Rex Gorell Motors
Pty Ltd ACN 006 649 869, RPBJ Pty Ltd ACN 114 494 397 and RPBJ Gorell Pty Ltd ACN 004

(c) Customer means any person or entity that places an order for Goods or for Services;
(d) Engagement means each of the following:
(i) an agreement between Rex Gorell Group and a Customer to provide Services on the Terms and Conditions;
(ii) an agreement between Rex Gorell Group and a Customer to provide Goods on the Terms and Conditions; or
(iii) a Customer visiting, accessing, browsing or otherwise engaging Rex Gorell Group;
(e) Goods means goods supplied by Rex Gorell Group to a Customer;
(f) Information means Personal Information and Sensitive Information;
(g) Personal information means information or an opinion (including information forming part of a database), whether true or not, and whether recorded in material form or not, about an individual whose identity is reasonably apparent, or can be reasonably ascertained, from the information or opinion.
(h) Privacy Policy means this privacy policy, as amended from time to time;
(i) Sensitive Information is defined in the Privacy Act to include things such as race, sexual orientation, political opinions, members of a trade association or trade union, criminal record or health information;
(j) Services means the services to be provided by Rex Gorell Group to a Customer;
(k) Terms and Conditions means Rex Gorell Group’s standard terms and conditions, as amended from time to time;
(l) Customer means any person or entity that makes an Engagement with Rex Gorell Group; and
(m) Website means www.rexgorell.com.au
3. COLLECTION
3.1 Rex Gorell Group only collects Information by fair and Iawful means where it is reasonable and practicable to do so.
3.2 The Information collected by Rex Gorell Group about a particular Customer will vary depending on the circumstances of collection. It may include, but is not limited to, a person's contact details (name, email and/or postal address, phone number), date of birth, gender, credit card details, driver's licence number, passport number, insurance details, employment history, working with children checks, police checks, qualifications, and digital images of people or communication history with Rex Gorell Group. If it is reasonably necessary in the circumstances, Rex Gorell Group may also collect Sensitive Information.
3.3 Sensitive information is afforded a higher level of privacy protection than Personal Information. Where a Customer provides Sensitive Information to Rex Gorell Group, the Customer provides consent to Rex Gorell Group collecting it in accordance with this Privacy Policy, unless the Customer tells Rex Gorell Group otherwise.
3.4 If a Customer does not provide Rex Gorell Group with the Information it reasonably requests, Rex Gorell Group may not be able to fulfill the Engagement.
3.5 Rex Gorell Group collects Information that Customers provide:
(a) in order forms submitted to Rex Gorell Group;
(b) when visiting the Website;
(c) during telephone, or in person, communications with Rex Gorell Group; and
(d) in written correspondence with Rex Gorell Group (including email correspondence).
4. USE AND DISCLOSURE OF INFORMATION
4.1 Rex Gorell Group may use and disclose Information collected from Customers for the primary purpose for which it is collected, for reasonably expected secondary purposes which are related to the primary purpose and for any other purpose authorised by Australian Privacy Law. In general, Rex Gorell Group uses and discloses Information to:
(a) properly and efficiently carry out Rex Gorell Group’s business;
(b) provide Services and fulfill Engagements;
(c) provide customer support, customer surveys, product management and promotion;
(d) conduct Website administration and technical support;
(e) protect the rights, property or safety of Rex Gorell Group, Customers or third parties;
(f) market Rex Gorell Group’ business and Services;
(g) communicate with Customers; and
(h) comply with its legal obligations.
4.2 Rex Gorell Group will use all reasonable means to protect the confidentiality of Information collected from Customers whilst it is in Rex Gorell Group’s possession or control. Rex Gorell Group does not and will not sell or deal in the Information of Customers, except by providing information where necessary to motor vehicle manufacturers or distributors in relation to the sale or servicing of new or used motor vehicles.
4.3 Rex Gorell Group will not knowingly share any Information from Customers with any third party except where such Information is required to be disclosed in order to fulfil an Engagement the Customer has made or in order to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant or a law enforcement agency request.
4.4 If there is a change of control of Rex Gorell Group (whether by merger, sale, transfer of assets or otherwise) the Information of Customers could be disclosed to a potential purchaser under a confidentiality agreement. Rex Gorell Group would only disclose the Information of Customers in good faith in such circumstances.
4.5 Any non-personal information, communications and material collected by Rex Gorell Group from Customers may be kept, used and disclosed by Rex Gorell Group on a non-confidential basis. Rex Gorell Group is free to use and reproduce any such information freely, and for any purpose whatsoever.
5. DATA STORAGE
Please note that Information submitted to and collected by Rex Gorell Group may be stored on secure databases located both within Australia, and in some cases, on databases located overseas. If a Customer does not want their Information being stored outside Australia they should not submit Information to Rex Gorell Group when using the Website or entering into an Engagement with Rex Gorell Group.
6. ACCESSING AND UPDATING YOUR INFORMATION
6.1 All Customers, or their authorised representative(s), have a right to access, update and correct information that Rex Gorell Group holds about them.
6.2 Rex Gorell Group endeavors to ensure that Information about Customers is accurate, complete and up to date. Customers can view, update or delete their Information through contacting the Rex Gorell Group staff member they usually deal with, or by email request at:

7. COOKIES
7.1 To make the Website work properly, Rex Gorell Group places small data files called cookies on the Customer’s device. Most big websites do this too.
7.2 What are cookies?
A cookie is a small text file that a website saves on a computer or mobile device when a Customer visits the site. It enables the website to remember a Customer’s actions and preferences (such as login, language, font size and other display preferences) over a period of time, so they don't have to keep re-entering them whenever they browse from one page to another.
7.3 How does Rex Gorell Group use cookies?
(a) Only PHPSESSID is required to make the Website work. A Customer can delete or block the other cookies without losing any functionality.
(b) The cookie-related information is not used to identify a Customer personally and the pattern data is fully under Rex Gorell Group’ control. These cookies are not used for any purpose other than those described here.

7.4 How to control cookies
Customers can control and/or delete cookies as they wish - for details, see aboutcookies.org. Customers can delete all cookies that are already on their computers and can set most browsers to prevent them from being placed. If a Customer does this, however, the Customer may have to manually adjust some preferences every time they visit a site and some services and functionalities may not work. To provide website visitors the ability to prevent their data from being used by Google Analytics, Google have developed the Google Analytics opt-out browser add-on for the Google Analytics JavaScript (ga.js, analytics.js, dc.js).
8. CHANGE IN PRIVACY POLICY
As Rex Gorell Group is committed to ensuring this Privacy Policy remains current, this Privacy Policy is subject to change. Rex Gorell Group may modify this Privacy Policy at any time, in Rex Gorell Group’s sole discretion and all modifications will be effective immediately upon Rex Gorell Group posting the modifications on the Website. Customer’s should return to the Website periodically to review the terms of this Privacy Policy.
